New Construction

Spec vs to-be-built at Kingston or Rivergrass — what changes in deposit, contingency, and completion-risk questions?

By Mike PepplePublished Updated 4 min read

Spec/QMI and to-be-built change the risk shape: specs trade option freedom for a firmer close; to-be-built keeps design flexibility but stretches completion risk. Ask each Kingston or Rivergrass builder in writing about deposit/escrow (§501.1375), contingencies, completion language, option cutoffs, and punch-list remedies — never assume incentive dollars.

Key facts

  • Kingston post–Grand Opening reality: four builders selling with open models (Neal, Pulte, Lennar, Taylor Morrison); inventory stage can include model, quick-move-in/spec, and to-be-built homesites — stage changes deposit timing, option cutoff, and close-date certainty. Confirm stage per builder / per lot in writing. (Neal Grand Opening page; Cameratta Grand Opening page)
  • Rivergrass (Lennar) as of Oct 28, 2026: Coming soon / No homes available — expect mostly to-be-built / future release diligence until QMI/spec inventory appears; still use the same ask-list so you are ready when specs drop. (Rivergrass | Lennar)
  • Lennar Legal — Completion Date: unless otherwise noted in the purchase agreement, Lennar agrees to complete construction within two (2) years from the date the buyer signs the purchase agreement; delay defenses under state law can extend; contract controls. (Lennar Legal)
  • Fla. Stat. §501.1375 (2026): for covered one-/two-family sales, developer must notify buyer that deposits up to 10% of purchase price shall, unless waived in writing, be placed in escrow with listed escrow holders; conspicuous legend required in contracts. (Florida Senate)
  • §501.1375: buyer may waive escrow in writing; if not waived, withdrawals generally need both parties (with statute exceptions); builder may use funds for construction after notice + surety bond (or loan alternative); release rules cover proper termination, buyer default, and closing. Teach the statute — don’t guess a builder’s actual escrow practice. (Florida Senate)
  • Fla. Stat. §553.837 (2026): mandatory builder warranty for material Florida Building Code violations on newly constructed SF through quadruplex — 1 year from earlier of title transfer or initial occupancy; appliances under manufacturer warranty excluded; express written warranty may supersede if ≥ statutory scope. (Florida Senate)
  • Village / builder split still matters: Kingston South (Neal/Pulte/Lennar) vs Esplanade (TM) use different purchase agreements — never paste one builder’s deposit rules onto another. (Neal Grand Opening page)
  • Lennar Booking disclaimer again: appointment booking ≠ broker registration (builder registration timing) — first unaccompanied visit can kill co-broke eligibility while also starting the sales clock. (Lennar Legal)

Spec / QMI vs to-be-built ask-list (process)

  1. Is the home under construction / complete, or dirt / to-be-built?
  2. Exact deposit schedule + any escrow waiver.
  3. Contingencies that survive (financing, inspection, appraisal, sale of current home) — many builder contracts limit these.
  4. Completion / close date language + delay remedies.
  5. Option / design-center cutoff (often already passed on specs).
  6. Lot premium lock and whether it changes if you switch lots.
  7. Punch-list / walkthrough / holdback process.
  8. Assignment / rate-lock / incentive expiration (confirm written; don’t guess unpublished $).
  9. Which CDD assessment area the homesite sits in (Kingston One FY2027 table).

Same ask-list applies if you later tour Pulte/Lennar at Verdana — contracts remain builder-specific.

How the risk shape usually differs

QuestionSpec / QMI tendencyTo-be-built tendencyWhere the answer lives
Close-date certaintyOften firmer (home already progressing / complete)Longer; tied to construction schedule + contract completion clausePurchase agreement + addenda
Option / design freedomOften limited or already cut offWider — until design-center deadlinesDesign-center / option exhibits
Deposit / escrowStage-specific schedule; ask about §501.1375 notice / waiverOften staged with dirt start; same statute literacyContract + escrow legend
ContingenciesFrequently limited on builder paperAlso often limited — do not assume financing contingencyAddenda in writing
Completion remedyPunch-list / walkthrough focus≤2-year Lennar legal baseline (if Lennar) unless agreement says otherwise; other builders = their contractLennar Legal + that builder’s PA
IncentivesMay be time-boxed on inventoryMay differ by release — confirm written onlyDated incentive exhibit

Local example

After Kingston’s Oct 17, 2026 Grand Opening, a buyer comparing a Kingston South quick-move-in to a Rivergrass to-be-built interest list needed two different worksheets: the QMI path focused on option cutoffs already passed, punch-list process, and a firm close date; the Rivergrass path (Coming soon / no homes available as of Oct 28, 2026) focused on deposit/escrow waiver language under §501.1375, Lennar’s ≤2-year completion baseline, and registration timing before any first contact. Inventing an incentive dollar amount for either path would have been worse than leaving that cell blank until a dated exhibit arrived.

What this means for buyers

Inventory stage is a contract question. Spec convenience is not “safer” if contingencies and escrow waiver terms are worse; to-be-built flexibility is not “free” if completion language and assessment-area mapping are fuzzy.

What this means for sellers / relocators

When helping family choose between a Corkscrew resale and a builder QMI, put surviving contingencies and completion remedies on the new-construction side of the worksheet — brochure stage labels are not enough.

FAQ

What’s the difference between a Kingston spec and a to-be-built homesite?

Spec/QMI usually trades option freedom for a firmer close path; to-be-built keeps design flexibility but stretches completion risk. Confirm deposit, contingencies, and completion language per builder / per lot.

Will my deposit always be 10% in escrow?

No. §501.1375 is a notice / escrow framework for covered sales (up to 10%, unless waived in writing). Read the legend and any waiver in your contract — don’t guess the builder’s practice.

Does Lennar guarantee a close date inside two years?

Lennar’s legal Completion Date language sets a ≤2-year completion baseline from buyer signature unless the agreement says otherwise; delay defenses can extend. The purchase agreement controls — not a sales anecdote.

Can I reuse one Kingston builder’s deposit rules at another?

No. Neal, Pulte, Lennar, and Taylor Morrison run separate purchase agreements. Esplanade (TM) is not Kingston South paperwork.
