Boat slips, marina rights, and kayak storage — which branded and waterfront towers need this asked in writing before deposit?

By Mike PepplePublished Updated 4 min read
A private marina with boat slips and moored boats in front of waterfront luxury condominium towers, kayaks on a rack, Naples Florida bay, calm water

Before deposit on any branded or waterfront tower, get slip / marina / kayak rights in writing. Infinity marketing names a private marina and kayak park via Colony / Pelican Landing membership—confirm the legal interest. Kalea, Avra, and Bay Colony Gulf towers do not publish deeded-slip schedules here; assume nothing. New construction: request any § 718.503 marina/dock approvals.

Key facts

  • Process rule: treat marina / slip / kayak claims as deeded appurtenance vs license vs waitlist vs community amenity until the declaration, rules, marina policy, and purchase contract exhibits say otherwise—never from a brochure headline. Don’t guess wait years. (Fla. Stat. § 718.503 diligence process)
  • Infinity at The Colony developer marketing states residences come with a private marina and beach club, and that owners are automatic members of the Colony Foundation (a/k/a The Colony at Pelican Landing) and Pelican Landing Community Association, with access to amenities including the marina and kayak park, beach shuttle, and private island—confirm deeded vs license vs membership rules in current association docs before deposit. (infinitycolony.com — marketing)
  • Infinity building amenities list bicycle storage and a private two-car garage (one EV-ready outlet) on the developer amenities page—useful adjacent storage asks; still not a slip deed. Geography: Bonita Springs / Coconut Rd / Colony, not Naples city limits. (infinitycolony.com/amenities — marketing)
  • Kalea Bay public amenities marketing emphasizes rooftop terraces, ~100,000 SF amenity center, pools, tennis/pickleball, guest cottages, 24-hour security—no deeded-slip schedule published on the amenities page as of Oct 28, 2026. Ask in writing if any marina/dock/kayak rights exist; don’t guess them from “waterfront” branding. (kaleabay.com/amenities — marketing)
  • Avra FAQ markets Naples Bay / marina sunsets as nearby lifestyle, not a building-owned marina; parking/storage are garage-level assignments—ask downtown dock/marina rights separately if relevant; do not claim “includes marina.” (Avra FAQ / Home — marketing)
  • Bay Colony / Remington–Windsor–Biltmore–Trieste association tower pages emphasize Beach Club, Gulf access, pools, guest suites—no boat-slip schedules on the fetched tower pages. Slip/kayak rights (if any) must come from tower docs or BCCA materials in writing—don’t guess Pelican Bay / Bay Colony dock rights. (bay-colony.org tower pages)
  • Fla. Stat. 718.503 developer disclosure contemplates dock/marina facilities: if state/local acceptance or approval of dock or marina facilities intended to serve the condominium is required, the developer must furnish a copy of that acceptance/approval or a statement that it has not been acquired—use this ask on new waterfront products. (Fla. Stat. § 718.503(1)(b)16)

Written ask template (copy into your offer diligence list)

  1. Is a slip deeded, assigned, licensed, or waitlisted?
  2. Is it transferable with the unit?
  3. What are current annual fees / assessments (request the current schedule—don’t guess)?
  4. Vessel size / draft limits?
  5. Kayak / SUP rack rules and assignment method?
  6. Guest docking rights?
  7. Insurance requirements for vessels?
  8. Board approval path for transfers or new vessels?

(Parking and EV assignment questions belong on the urban-tower filter post—not here.)

Local example

A boater comparing Infinity at The Colony marketing to a Kalea Bay tower and a Bay Colony Gulf residence in October 2026 assumes “waterfront” means a slip. Correct diligence: (1) treat Infinity’s marina / kayak-park language as a membership claim to confirm in Colony Foundation / PLCA and condo docs, (2) ask Kalea in writing because the public amenities page reviewed here shows no deeded-slip schedule, (3) ask Bay Colony tower + BCCA materials in writing because Remington/Windsor/Biltmore/Trieste pages emphasize Beach Club—not slips, and (4) for any new waterfront contract, request the 718.503 dock/marina acceptance item. Beach access is not boat rights.

What this means for buyers

If vessel storage is a must-have, put slip / kayak language on the critical path of your inspection period. Marketing “marina” without a legal interest is not a purchase. Keep parking/EV questions on the urban Avra filter—do not collapse them into this marina post.

What this means for sellers

If your unit includes a deeded or assigned slip, say so with the recorded instrument or association assignment—not with lifestyle copy. If it does not, say that early so boaters do not waste a deposit cycle.

FAQ

Does Infinity include a deeded boat slip with every residence?

Developer marketing names a private marina and kayak park via Colony / Pelican Landing membership. Confirm whether your interest is deeded, licensed, or membership-based in current association documents before deposit.

Does Kalea Bay include marina slips?

The public amenities materials reviewed here do not publish a deeded-slip schedule. Ask the association in writing; don’t guess slips from “waterfront” branding.

Do Bay Colony Gulf towers include docks?

Tower pages reviewed emphasize Beach Club and Gulf access, not boat-slip schedules. Request tower docs or BCCA materials in writing if docks matter to you.

What should new-construction buyers ask about marinas under Florida condo law?

Under Fla. Stat. § 718.503, request any required state/local dock or marina acceptance/approval—or a statement that it has not been acquired.

Are kayak racks the same as slips?

No. Ask separately for kayak/SUP assignment rules, fees, and transferability—still in writing.
